1. AVAILABILITY: US only. Continental US, Hawaii, and Alaska. FWA Plans are not available in New York.
- Standard plan: Requires a qualified business service address; exclusions apply.
- Premium plan: Requires a qualified business service address; not available at residential business locations. (Not yet available)
- To qualify for Services using FWA Wireless Service plans, End User must have an approved service address in an Aeris operated coverage area that is eligible for Aeris FWA Service (“Approved Service Address”).
- Service areas for FWA End-User Approved Service Addresses are determined by coverage and capacity availability on the local mobile network and may change from time to time.
- If your Service is canceled or terminated, you may not qualify to reactivate the Service if your location is deemed no longer eligible. When used indoors, plans also require sufficient in-building cellular coverage to work optimally. You should assess whether there is sufficient in-building coverage at your desired location prior to purchase.
- 2. SERVICE RESTRICTIONS: You may not use FWA Service at any address other than your designated service address without Aeris’s express prior written approval. If you use Aeris’s FWA Service at a location other than your designated service address without such approval, the service may not operate as intended, and Aeris reserves the right to (a) move you to an available FWA or other plan and charge you the corresponding monthly amounts or (b) terminate the Service. Aeris will notify you prior to taking one of these actions. You can request eligibility review/approval for a service address change with your Aeris representative.
- 3. DATA: For use in the United States (except New York) at your designated service address only. All Aeris Service is subject to Aeris Network management practices. Tethering/mobile hotspot use is allowed with compatible devices.
- 4. DATA SPEEDS: The speed of Aeris FWA Service is very dependent upon the connection your wireless router can achieve with the Aeris Network. Many things can affect the availability and quality of your service including, but not limited to, your proximity to the cell site, the position of your device within your location, local congestion caused by use of network capacity by high numbers of users simultaneously using data intensive applications in the vicinity of the cell tower serving your designated service address, blockage of the signal between the designated service address and the cell tower (caused by objects such as buildings, foliage, etc.), Aeris Network management practices, and weather. As such, performance, experience, and speeds will vary and are not guaranteed. To maximize performance, you should make every effort to position your router in an optimal position for your location.
- 5. DATA RESTRICTIONS: Standard plan: For all data usage, Aeris’s Wireless Provider Partners may temporarily slow data speeds if the network is busy.
- Premium plan: (not currently available) Plan includes a network-based quality of service (QoS) feature that assigns a higher priority level (as compared to the Standard plan) for your first 250GB of data traffic originating on and traveling over the domestic network in each bill cycle.
- Standard Plan: After 250GB of data usage in a bill cycle, then for all data usage for the remainder of the bill cycle, the network provider may temporarily slow data speeds if the network is busy. Feature does not (a) prioritize data traffic ahead of all other data traffic (which may receive a similar or higher QoS), (b) provide priority access to available network resources, or (c) provide preemption capabilities.
- FWA Service Limitations: the network vendor may engage in any reasonable network management practice to enhance customer service, to reduce network congestion, to adapt to advances and changes in technology, and/or to respond to the availability of wireless bandwidth and spectrum. In order to ensure the best quality of service for all customers using the mobility network, during times of heavy network congestion, the network provider may (a) temporarily prioritize services that may be most severely impacted by congestion; and/or (b) temporarily de-prioritize and/or throttle services deemed likely to contribute to heavy congestion.
- 6. The Customer may use these Plans for open Internet access.
- 7. These Plans require the Customer to use the Wireless Service only with a compatible hotspot or router. Partner plans can be sold as an IOT-integrated solution with the restriction of no Resale to Resale or Resale to Consumers.
- 8. These Plans are not intended for high bit rate applications & may not be used for server devices or host computer applications (such as continuous web camera posts or broadcasts), for high bandwidth applications, services or content that disproportionately and excessively contribute to network congestion (such as web broadcasting), or in any other manner prohibited by your Business Agreement (see prohibited network uses/activities in the Additional Service and Equipment-Related Terms)
